U ovom blog \u010dlanku dajemo vam detaljan pregled najva\u017enijih aspekata naslednog prava u Crnoj Gori, od zakonskih nasljednika do poreskih aspekata i prakti\u010dnih savjeta za nasljednike i ostavioce.<\/strong><\/p>\n<\/p>\n<h3>Pravne osnove naslednog prava u Crnoj Gori<\/h3>\n<p>Crnogorsko nasledno pravo se uglavnom zasniva na Zakonu o naslje\u0111ivanju. Ovaj zakon reguli\u0161e sve aspekte naslje\u0111ivanja, uklju\u010duju\u0107i odre\u0111ivanje nasljednika, raspodjelu imovine i obaveze nasljednika.<\/p>\n<p>Nasljedno pravo u Crnoj Gori prepoznaje dvije glavne vrste naslje\u0111ivanja: bezostavno i testamentarno naslje\u0111ivanje.<\/p>\n<\/p>\n<h3>Pravna sukcesija<\/h3>\n<p>Ako nema testamenta, stupa na snagu nasledstvo bez oporuke. Pravna sukcesija u Crnoj Gori slijedi specifi\u010dnu \u0161emu koja uzima u obzir porodi\u010dne odnose preminulog:<\/p>\n<ol>\n<li><strong>Prva klasa naslje\u0111ivanja:  <\/strong><br \/>Bra\u010dni drug i djeca umrlog naslje\u0111uju ravnopravno. Ako dijete umre, njegovi potomci naslje\u0111uju na njihovo ime.\n<\/li>\n<li><strong>Drugi razred naslje\u0111ivanja:  <\/strong><br \/>Ako nema naslednika prvog naslednog reda, nasle\u0111uju roditelji umrlog i njihovi potomci.\n<\/li>\n<li><strong>Tre\u0107a klasa naslje\u0111ivanja:  <\/strong><br \/>Baka i djed umrlog i njihovi potomci naslje\u0111uju ako nema nasljednika iz prvog i drugog reda.\n<\/li>\n<li><strong>\u010cetvrta klasa naslje\u0111ivanja:  <\/strong><br \/>Prabake i djedovi i njihovi potomci.<\/li>\n<\/ol>\n<h3>Testamentarno nasle\u0111e<\/h3>\n<p>Crnogorski zakon dozvoljava ostaviocu da raspola\u017ee svojom imovinom putem testamenta. Va\u017ee\u0107a oporuka se mo\u017ee sastaviti rukom, kod notara ili kao usmena oporuka u posebnim okolnostima.<\/p>\n<p>Oporuka mora ispunjavati odre\u0111ene formalne uslove da bi bila validna:<\/p>\n<ul>\n<li><strong>Rukopisno \u0107e:  <\/strong><br \/>Mora biti u potpunosti napisan rukom i potpisan od strane ostavioca.\n<\/li>\n<li><strong>Javnobilje\u017eni\u010dki \u0107e:  <\/strong><br \/>Mora se sastaviti kod notara i potvrditi od dva svjedoka.\n<\/li>\n<li><strong>Usmeni \u0107e:  <\/strong><br \/>Va\u017ei samo u izuzetnim okolnostima, na primjer ako je ostavilac u \u017eivotnoj opasnosti i nema mogu\u0107nosti da sa\u010dini pismeni testament.<\/li>\n<\/ul>\n<h3>Potra\u017eivanje prinudne dionice<\/h3>\n<p>Crnogorsko nasljedno pravo \u0161titi odre\u0111ene bliske srodnike ostavioca kroz tzv. prinudni dio. Po pravilu, bra\u010dni drug i deca ostavioca imaju pravo na obavezni deo. Obavezni dio je polovina zakonskog dijela zaostav\u0161tine i ne mo\u017ee se povu\u0107i testamentom osim ako za to postoje ozbiljni razlozi navedeni u zakonu.<\/p>\n<\/p>\n<h3>Naselje imanja<\/h3>\n<p>U Crnoj Gori se imovina rje\u0161ava u sudskom postupku. Nadle\u017eni sud ispituje testament, ako ga ima, i utvr\u0111uje zakonske nasljednike. Imovina se zatim raspore\u0111uje u skladu sa zakonskim odredbama ili uputstvima u testamentu.<\/p>\n<\/p>\n<h3>Poreski aspekti<\/h3>\n<p>Porez na naslje\u0111e u Crnoj Gori je relativno nizak u pore\u0111enju sa mnogim drugim zemljama. Ne postoji porez na nasledstvo za bliske srodnike (supru\u017enik, deca, roditelji), dok dalji ro\u0111aci i nesrodnici moraju da plate umereni porez na nasle\u0111enu vrednost.<\/p>\n<\/p>\n<h3>Me\u0111unarodni aspekti naslednog prava<\/h3>\n<p>Crna Gora je dio razli\u010ditih me\u0111unarodnih sporazuma koji uti\u010du na pravo naslje\u0111ivanja, posebno u kontekstu Evropske unije. Ovi sporazumi olak\u0161avaju prekograni\u010dno priznavanje i izvr\u0161enje naslednih prava i testamentarnih raspolaganja.<\/p>\n<\/p>\n<h3>Ako se ne mo\u017ee na\u0107i nasljednik<\/h3>\n<p>Ako se ne mo\u017ee prona\u0107i nasljednik, dr\u017eava nastupa kao nasljednik. Ovo je jasno regulisano zakonom. U takvim slu\u010dajevima sve stvari pokojnika postaju vlasni\u0161tvo dr\u017eave. Ovo uklju\u010duje i pokretnu i nepokretnu imovinu. Tada dr\u017eava preuzima i obaveze i dugove umrlog do visine zaostav\u0161tine.<\/p>\n<p>Dr\u017eavni organi su odgovorni za upravljanje imovinom i pla\u0107anje svih dugova. Preostala imovina se sliva u dr\u017eavni bud\u017eet. Ovaj mehanizam osigurava da nijedna imovina ne ostane neiskori\u0161tena i da se ispunjavaju obaveze preminulog.<\/p>\n<\/p>\n<h3>Nasljedno pravo za nevjen\u010dane parove<\/h3>\n<p>Prema crnogorskom zakonu o naslje\u0111ivanju, nevjen\u010dani parovi nisu automatski za\u0161ti\u0107eni naslje\u0111ivanjem bez oporuke. To zna\u010di da pre\u017eivjeli partner nema zakonsko pravo na pokojnikovu imovinu osim ako ne postoji oporuka.<\/p>\n<p>Stoga je posebno va\u017eno za nevjen\u010dane parove da sastave oporuku kako bi osigurali da se njihov partner uzme u obzir u slu\u010daju smrti. Testament nudi mogu\u0107nost da svog partnera imenujete kao nasljednika i tako mu garantujete finansijsku sigurnost. Bez takve oporuke, zaostav\u0161tina bi pre\u0161la na pokojnikov najbli\u017ei srodnik prema zakonskim pravilima naslje\u0111ivanja.<\/p>\n<\/p>\n<h3>Prakti\u010dni savjeti za ostavioce i nasljednike<\/h3>\n<ol>\n<li><strong>Napravite oporuku:  <\/strong><br \/>Kako biste osigurali da va\u0161a nekretnina bude raspore\u0111ena prema va\u0161im \u017eeljama, preporu\u010dljivo je sastaviti oporuku. Ako je potrebno, potra\u017eite savjet od advokata ili notara.\n<\/li>\n<li><strong>Obavestiti naslednike:  <\/strong><br \/>Pobrinite se da va\u0161i nasljednici budu svjesni postojanja i lokacije va\u0161e oporuke.\n<\/li>\n<li><strong>Organizujte dokumente:  <\/strong><br \/>Dr\u017eite va\u017ene dokumente kao \u0161to su rodni listovi, vjen\u010dani listovi i dokaz o vlasni\u0161tvu organiziranim i lako dostupnim.\n<\/li>\n<li><strong>Poreski savjet:  <\/strong><br \/>Dobijte savjet o mogu\u0107im poreznim obavezama u slu\u010daju naslje\u0111a, posebno ako me\u0111unarodni aspekti igraju ulogu.<\/li>\n<\/ol>\n<h3>Zaklju\u010dak<\/h3>\n<p>Nasljedno pravo u Crnoj Gori nudi jasna pravila i mehanizme za\u0161tite kako za ostavioce tako i za nasljednike. Kombinacija zakonskog i testamentarnog naslje\u0111ivanja, kao i za\u0161tita koju obezbje\u0111uje obavezni dio, osigurava pravednu raspodjelu imovine.
